Drive Designz LTD: General Terms and Conditions and Disclaimer

Payment is due as invoices state when they are received unless credit terms have been extended with credit references supplied.

A 30% deposit is required for all services offered; this will book in your vehicle officially. The remaining 70% is required to be paid before your vehicle can be collected. No vehicle will be handed over to the owner until the full amount owing is paid. If the remaining 70% of payment is not paid within 14 days, you will be liable to pay a collection fee of 5% of the amount outstanding. If in an extreme case your due amount remains outstanding, we will pass your account on to a debt collection agency. You will be liable for any fees incurred as part of the debt collection process. We also reserve the right to halt any services we provide to you in the event of an unpaid account.

Pre-Inspection
At the time of drop-off, one of our installers will complete a pre-inspection of your vehicle and discuss if any panels have paint issues and require further attention.

Drive Designz LTD does not warranty any work that a customer has agreed for us to arrange through a third party.

Drive Designz LTD is not responsible for losses or damage to cars or articles left in the car in case of fire, theft, or any causes beyond control.

Drive Designz LTD will not be liable for any damages incurred when the vehicle is left outside the shop.

Use of Images and References on Completed Work
Drive Designz LTD may, at its sole discretion, use images or video footage of completed work and/or refer to the client in Drive Designz LTD portfolio and any other marketing materials, including but not limited to press releases, brochures, flyers, signs, videos, and vendor marketing materials promoting Drive Designz LTD and its services.

Payment Terms

Nonrefundable deposit:
Drive Designz LTD requires a 30% nonrefundable deposit to lock in a time and day to start works. This deposit is nonrefundable if the customer decides to cancel works before they start for any reason. The deposit can be used at a later date toward other works only if the cancellation is made one week prior to the install date.

A 30% nonrefundable deposit with the order confirmation, prior to printing or installing, with the balance to be paid before vehicle drop-off. Before collection or delivery or upon pickup of the vehicle, the remaining 70% of the final balance must be paid in full. Once the work is performed and before the client takes possession of their vehicle, the client must pay Drive Designz LTD the remaining balance due for the installation. Payment must be made 100% in full before vehicle handover.

In the event that the customer fails to make payment in full on the job invoice, the customer irrevocably authorizes Drive Designz LTD to remove the graphics supplied. Since these are custom jobs, once the job is printed, delivered, and/or installed, all contracts are final, and no monetary refunds can be issued.

Vehicles must be delivered to our location clean and free from grease and oil or any prior-applied ceramic coatings. A cleaning charge of $100.00 or more may be applied if the vehicles are not in a satisfactory clean condition unless stated otherwise.

All graphics remain the property of Drive Designz LTD until paid for in full. Pending payment for goods supplied, the customer holds the goods as the property of Drive Designz LTD, and the goods must be kept identified as belonging to Drive Designz LTD. In the event that the customer fails to make payment, the customer irrevocably authorizes Drive Designz LTD to remove the graphics supplied.

Disputes
Clients shall identify to Drive Designz LTD in writing any dispute within 30 days of the date of the invoice. If disputes are not identified in writing, the client has accepted the invoice. Clients must return to Drive Designz LTD any and all work in dispute, accompanied by a written explanation. After investigation, errors on our behalf will either be corrected or credited to the client’s account.

We will not accept responsibility for consequential damages or loss of any kind resulting from the sale, installation, or delivery of our wrap products. It is the client’s responsibility to read the fine print thoroughly before contracting Drive Designz LTD to perform any vehicle wraps.

Returns/Disputes

If the client has a concern with the job, Client must contact Drive Designz LTD in writing before proceeding with any chargebacks or credit returns. Drive Designz LTD will offer 30 days’ opportunity to correct and resolve any disputes prior to any legal action. All banners and vehicle wraps are custom-made projects that are not refundable. If the client has a concern with the job, Client must contact Drive Designz LTD in writing before proceeding with any chargebacks, credit returns, or legal action. Drive Designz LTD will be given the opportunity to review the complaint, respond, and resolve the issue. After Drive Designz LTD has addressed the concerns, the client has the right to negotiate an agreement. If no agreement is reached, mediation must be attempted before any claims are pursued.

Since all jobs are custom products, Drive Designz LTD must be given the opportunity to reprint or reinstall any job before the client initiates any credit card chargebacks or returns. In the event of a credit card dispute, if the decision is made in favor of Drive Designz LTD, the client will be held liable for all legal fees, research, and discovery costs associated with the inquiry. Additionally, if the dispute affects Drive Designz LTD’s ability to process credit card business, the client will be liable for all associated losses.


Job Cancellation and Errors

If the client cancels the order before its completion, the client is responsible for the cost of any proofs, artwork, materials, and work completed up to the point of cancellation. Additionally, Drive Designz LTD reserves the right to charge a 15% cancellation fee to cover internal costs, including scheduling, communication, and resources used.

Drive Designz LTD is not responsible for errors in work after final client sign-off or neglect of final sign-off. Claims will not be honored after 24 hours of receipt of completed work. Verbal orders are accepted, but in the absence of supportive documentation, Drive Designz LTD is not responsible for verbal errors. All agreements must be in writing, and Drive Designz LTD is not liable for inaccuracies in telephoned or faxed orders. Drive Designz LTD does not offer refunds.


Limitation of Liability and Confidentiality

Drive Designz LTD and the client understand that during their business relationship, both parties may share confidential information or trade secrets. Both parties agree to treat such information as confidential.


Project Start Time, Substrates, and Installation

The project start time begins only after all support files are received, the client approves the artwork, and the client is accepted for credit and billing terms. Drive Designz LTD will consult with the client to determine the appropriate substrates and processes for the project, but the client is ultimately responsible for determining suitability.

Drive Designz LTD is not responsible for delays caused by weather conditions, which may incur additional costs payable by the client. Adverse weather may also necessitate the postponement of installation.


Trademarks and Copyrights

Reproducing copyrighted materials without permission is illegal. It is the client’s responsibility to obtain such permissions. Drive Designz LTD assumes the client has secured permissions before submission and is not liable otherwise.


Design and Printing

The client owns the exclusive rights to final designs upon full payment. All other designs and materials remain the property of Drive Designz LTD. The client is responsible for checking the accuracy of supplied artwork and ensuring it is “print ready.” Drive Designz LTD charges $90/hour for design modifications or adjustments to client-provided artwork.

Proofs must be approved before printing. Drive Designz LTD is not responsible for errors after client approval.


Additional File Set-Up/Design Charges and Color Matching

File set-up exceeding the included rate is charged at $90/hour. Drive Designz LTD cannot guarantee exact PMS color matches due to the nature of digital printing.


Estimates and Taxes

Orders are subject to applicable state and local taxes.


Vehicle Wraps: Additional Terms, Conditions, and Warranty Disclaimer

Installations

Graphics applied to vehicles may not precisely match digital proofs due to vehicle contours. Drive Designz LTD disclaims responsibility for paint on vehicles older than six years or vehicles with non-OEM paint. Wrapping over existing decals is at the client’s risk.

Vehicle wraps are not paint. Minor areas may reveal the original color of the vehicle. Variations in proof and final product are expected due to 3D surfaces. Seams and overlaps are part of the wrapping process.

Missed Appointment Policy

If a scheduled repair appointment is missed without prior notice or rescheduling, Drive Designz LIMITED may decline to offer further rescheduling.

We kindly ask for at least 24 hours’ notice for cancellations or changes.

Commercial Wraps

A commercial vehicle wrap is made by applying 137.16cm (unless specified otherwise) vertical panels of vinyl. There will be 2.54cm seams where the panels meet. On a complex design with many matching points, Drive Designz LTD cannot guarantee that the graphics will match 100% alignment due to extreme complex curves on the vehicle. A 5% margin is considered acceptable on large outdoor advertising projects. Proofs are created on a flat surface and viewed at a relatively tiny size on computer screens and 20.32cm printed paper. In cases of curves, handles, deep grooves, rubber moldings/trim, on-the-spot adjustments may be made by the installer to assure maximum readability or alignment. In many cases, there are slight differences between the printed flat paper proof and the 3-dimensional curved vehicle wrap. Due to the fact that a two-dimensional print is being applied to a three-dimensional vehicle and due to the minor variances in the accuracy of the templates. A piece of vinyl has limits and can only stretch so much before it changes color. In some cases, a relief cut has to be made into the vinyl that will reveal a small amount of the original vehicle’s paint color under the vinyl. In some cases, a patch needs to be installed to conceal the vehicle’s original color. It is the only option. Areas under door handles, mirrors, behind gas caps, and inside door frames will not be wrapped. If we wrap extreme curved surfaces such as mirrors and bumpers, they may reveal the original paint color at the tight edges of the wrap. It has more to do with material limitations and not install quality.

If we are installing at the client’s nominated location, suitable conditions must exist. Vehicles need to be indoors, in a clean, dust-free, temperature-controlled environment, with a power supply and good quality lighting. With a minimum of 1.524 meters working space around the entire vehicle. Wraps are self-adhesive vinyl that will only adhere well to catalyzed vehicle paint and glass. Poor surface paint or clear coats will not allow the vinyl adhesive to stick properly, and the adhesive may fail. Extreme curves and deep pockets may exceed the limits of how far the material can stretch. Again, this is not paint it is a special pressure-sensitive vinyl material.

Drive Designz LTD cannot be held responsible for any damage, void of vehicle warranty, or anything caused through the application of the vinyl products. Drive Designz LTD is not liable if during the installation of a wrap the clear coat of the car begins to peel off. Original painted vehicles will not have any problems with the clear coat peeling off.

It’s not a good idea to rush the install process. Many things can go wrong. Drive Designz LTD reserves the right to take an additional day.

The wrap material that is used for vehicle wraps does not stick very well to plastic or rubber parts such as window trims, side plastic moldings, and plastic door handles. It is advised that these areas NOT be wrapped with adhesive vinyl. Initially, the vinyl will stick, but over a short period, such as a few months, the vinyl will fall off these areas. In most cases of vinyl lifting, if it is a material’s problem, the lifting will present itself in the first few weeks after the initial installation. In most cases, it is advised that the vehicle wrap be fixed so that the vinyl does not continue to peel back and become contaminated.

It is not uncommon to see small areas of the wrap lifting soon after the installation is complete. Several factors can affect the vinyl’s adhesive ability to stick to the vehicle surface. Here are a few:

  • If the surface is not prepared properly before the wrap, then the adhesive can fail to stick over time.
  • Extreme temperatures can affect the vinyl adhesive (very cold or very hot temperatures).
  • Extreme humidity in the air during installation can affect the adhesive.
  • Dust in the air during installation.

You do not want to rush the installers because this type of work is all done by hand, and it takes time to install the vinyl with perfect placement.

The vinyl that is applied to original vehicle paint is warranted against adhesive failure and image quality for up to 4 years using 3M or Avery vinyl. The perforated window material is warranted for up to 1 year.

Imperfections

Though we strive for perfection in our installations, due to the nature of the product and environment, some degree of dust contamination and/or minor imperfections may be present in every PPF application. Pre-existing flaws, scratches, and rock chips on the paint are often much more noticeable after the PPF is installed. PPF may have minor imperfections like orange peel, small nibs, and bubbles. Used and older vehicles will have more imperfections due to age.

Matte Paint

Due to the nature of your vehicle’s Matte Paint Finish, we are unable to compound or polish the vehicle to remove any imperfections prior to coating. This will result in those imperfections being covered by the Ceramic Coating(s) or PPF, essentially “locking them in.”

Due to the Matte Paint Finish not being able to be compounded or polished, Drive Designz LTD does not offer a warranty on coatings or PPF applied to Matte Paint, as there is no way to safely remove the coatings without damaging the matte finish. Should any part of the vehicle ever need to be re-coated for any reason, it is understood that the part would need to be repainted or replaced with a new part prior to the recoating.

Ceramic Coatings: Additional Terms, Conditions, and Warranty Disclaimer

This disclaimer serves to notify you, the client, that Ceramic Coatings are scratch-resistant but not scratch-proof. Any scratches, swirls, chips, or other types of physical damage caused by abrasion can occur and are not covered by any warranty. We offer several brands of ceramic coatings, and each brand has its own manufacturer warranty.

Drying & Curing Times

The first 24 hours after your vehicle is coated is considered the drying time. We will hold onto your vehicle during this time, as it is crucial that it does not see environmental contamination or rain during this period. Once dry, your vehicle is safe to leave our shop and drive. It will continue to cure; full cure time is 14 days from application. During the 14-day curing period, it is crucial that you do not wash your vehicle with any chemicals. In the event bird droppings get on the vehicle, you can safely remove them with a silica waterless wash, or water, and a microfiber towel. In the event sap, tar, or other harsh products get on your vehicle, we ask that you bring the vehicle to us, and we can remove these safely and treat any affected surfaces as needed.

Ceramic Coatings On Your Wheels

If any brake dust or other contaminants are on your wheels, it is advised to clean them off as soon as possible to prevent stains from occurring. It is understood that the longer something sits on a vehicle’s wheel, even if coated, the wheel can become stained, and that stain or discoloration may not be removable. No warranty covers wheel staining or re-coating.

Glass Coatings

Glass, although in a solid state, is still a porous surface. A coating on your glass is intended to make your windows easier to clean and improve visibility in bad weather. It is not applied with the intent of protecting against chips, cracks, or etchings of any kind.

Glass Coating Maintenance: Cleaning can be done by the end user with any ammonia-free glass cleaner.

Matte Paint

Due to the nature of your vehicle’s Matte Paint Finish, we are unable to compound or polish the vehicle to remove any imperfections prior to coating. This will result in those imperfections being covered by the Ceramic Coating(s) or PPF, essentially “locking them in.”

Window Tints: Additional Terms, Conditions, and Warranty Disclaimer

What you should know before getting your windows tinted:

This list is not written to scare you away from getting your windows tinted but to help keep you informed.

  • Window Tint is designed to be viewed from 5’ away, not 6”. While window tint looks nice, its primary function is not for cosmetic purposes most of the time. Window film blocks 98-99% of UVA/UVB rays and can reduce heat by up to 60%.
  • Imperfections are normal in the first 4 weeks, including hazing, moisture, and bubbles. Do not touch the film if you see any of these imperfections, as it can make them worse and cause damage that isn’t included in your warranty.
  • A Dot Matrix comes on some vehicles from the factory. These are small iron dots that can push the tint away from the window. We have different options available if this is a cosmetic concern for you.
  • On some makes/models, the window seals are so tight that we cannot always get the film to “tuck” in fully on the sides. This is sometimes an issue with foreign vehicles and may result in additional charges for extra time.
  • On framed roll-up windows, there will be a slight gap at the top. The film cannot go all the way to the edge, as it may peel.
  • While we always try our hardest to keep dirt from contaminating the film, we cannot stop all the particles in the air.
  • All film includes a lifetime warranty covering fading, peeling, discoloration, bubbling, and other defects of the film. However, the following are not covered: damage caused by breakage, stickers, sharp objects, seat belts, rings, animals, or any other type of physical abuse to the film.

Window Tint Instructions

  • Drying period: Your tint will take about 2 to 3 weeks to fully dry and cure. Tinted windows may appear hazy, lumpy, or have water bubbles.
  • Do not roll windows down for 48 hours or attempt to push out water until dry! The rear windshield will be the most noticeable area. Please allow it to dry and cure fully.

Cleaning

  • Do not use anything that contains ammonia.
  • Use only chemicals or sprays safe for tinted windows, mild detergent with water, and soft paper towels or microfiber cloths for cleaning.

Imperfections

Due to the nature of the product, some degree of dust contamination and minor imperfections are present in every window film application. Pre-existing flaws, scratches, and metal deposits on the glass are often more noticeable after the windows are tinted. Although we strive for the best result possible, contaminants may still end up on the film. This is unavoidable and common.

Electrical Issues After Install

Modern vehicles are equipped with numerous electrical components. While we take every precaution to avoid damage during the tinting process, there are inherent risks associated with water application, which may expose these systems to moisture and runoff.

Drive Designz LTD cannot be held responsible for any damages to electrical systems during or after the tinting process, including the risk of damage to the Electronic Control Unit (ECU) or other components during windshield installations.

By proceeding with the installation, you acknowledge and accept the risks involved with the tinting process and release Drive Designz LTD from liability for potential electrical damages.

Dot Matrix

Most cars have a black ceramic edge on the top of the window. Sometimes this edge is straight and flat; other times, it has a dotted edge. These areas are thick and prevent the window film from sticking properly, resulting in a blurry-looking strip on the glass.

Window Tint Terms and Conditions

  • DO NOT LOWER YOUR TINTED WINDOWS FOR 2 DAYS.
  • DO NOT CLEAN WINDOW FILM UNTIL 30 DAYS AFTER INSTALLATION.
  • Use only TINT-SAFE, AMMONIA-FREE glass cleaners or mild detergent with water and a soft microfiber cloth.
  • Complete DRY-OUT time, including trapped moisture and bubbles, can take 30 to 60 days.
  • Customers accept all liability for tints darker than the legal limit of 35% on driver/passenger windows and on all sedans or mini SUVs.
  • Barely visible seams, borders, and dust specks are considered QUALITY WORK.
  • Seams may be used where glass curvature dictates.
  • Decals will be removed unless instructed otherwise.
  • Drive Designz LTD is not responsible for malfunctions of rear defrosters or wires.
  • Scratches on windows are not the responsibility of Drive Designz LTD.

Warranty and Further Disclaimers

Drive Designz LTD Installation Warranty

This three-month workmanship warranty covers our installation work only. It excludes damage caused by you or others, wear and tear, or mistreatment of the wrap. It covers lifting, peeling, or bubbling due to installation errors.

High wear areas, such as door handles, will only be warrantied once unless an issue is identified immediately after installation.

This warranty does not cover:

  • Metal, plastic, matte, or satin surfaces.
  • Non-painted primed vehicles or repainted vehicles, as we cannot guarantee the quality of the paintwork underneath.

Warranty on Labor and Materials

Drive Designz LTD offers:

  • A three-month warranty on installation.
  • Athree-month on materials applied to windows and cast laminated adhesive vinyl for vertical surface areas.

No warranty applies to horizontal surfaces, such as roofs and front hoods, exposed to direct sunlight. Vinyl on such surfaces should be replaced immediately if cracking occurs.

  • Hand washing only is recommended. Avoid high-pressure washing, ice scrapers, and harsh chemicals.

Warranty on Third-Party Work

Drive Designz LTD may offer some services through third-party providers. These services are not warrantied by Drive Designz LTD, as the work is not performed directly by us.

Drive Designz LTD may use images or videos of completed work and refer to the client in its portfolio and marketing materials, including press releases, brochures, videos, and vendor marketing.
